Welcome to myhnaproperties.com (the “Website”), owned and operated by Myhna Properties Pvt Ltd, doing business as Myhna Properties (“Myhna Properties”, “we”, “us”, or “our”). Our portfolio of residential projects — Myhna Vistara, Myhna Orchid, Myhna Maple, and Myhna Heights is accessible through this Website and its associated project microsites. 

By accessing or using this Website, you (“User” or “you”) agree to be bound by these Terms of Use (“Terms”), our Privacy Policy, and any additional guidelines or rules posted on the Website. If you do not agree with any part of these Terms, please do not use this Website. 

These Terms apply to all visitors, enquirers, prospective buyers, channel partners, and any other persons who access the Website for any purpose. 

2. Definitions 

For the purposes of these Terms, the following definitions apply:

Any enquiry, contact, or callback request form submitted through the Website or via integrated third-party platforms (Google Ads, Meta Ads). 

“Projects” 

The residential development projects of Myhna Properties, including Myhna Vistara (Gunjur), Myhna Orchid, Myhna Maple, and Myhna Heights. 

“Channel Partner” 

Any RERA-registered real estate broker or co-broking agency authorised by Myhna Properties to facilitate sales. 

“RERA” 

The Real Estate (Regulation and Development) Act, 2016, and the Karnataka Real Estate Regulatory Authority (K-RERA). 

 

3. Permitted Use of the Website 

This Website is made available for lawful, personal, and non-commercial use only. You may use the Website to browse project information, download publicly available brochures, submit lead enquiries, view construction updates, watch videos, and contact our sales team. 

3.1 You Agree NOT to: 

  • Copy, reproduce, distribute, or republish any Content from this Website without our prior written permission. 
  • Scrape, crawl, or use automated tools to extract data, pricing information, or lead generation assets from the Website. 
  • Submit false, misleading, or fraudulent information in any Lead Form or communication with our team. 
  • Impersonate Myhna Properties Pvt Ltd, its employees, sales agents, or authorised channel partners. 
  • Use the Website to send spam, unsolicited marketing, or phishing communications. 
  • Attempt to gain unauthorised access to the Website’s backend, databases, or admin systems. 
  • Use this Website in any way that violates applicable Indian laws, including the IT Act, 2000 and the IT (Amendment) Act, 2008. 
  • Publish, link to, or redirect users to competitor listings, negative reviews, or defamatory content about Myhna Properties using assets from this Website. 

3.2 Channel Partner Use 

Registered channel partners accessing the Website for lead management, brochure downloads, or pricing information must operate strictly within the scope of their signed Channel Partner Agreement. Unauthorised bidding on Myhna Properties’ branded terms on Google Ads, Meta Ads, or other platforms using the Website’s Content is a material breach of these Terms and the applicable partner agreement. 

4. Accuracy of Project Information 

Myhna Properties endeavours to ensure that all information on this Website is accurate and up to date. However, the real estate sector involves dynamic pricing, regulatory timelines, and construction schedules. You acknowledge and agree that:

Floor Plans & Layouts 

Plans shown are representative. Actual dimensions may vary by tower, floor, and unit. Binding layouts are those registered with K-RERA. 

Renders & Visuals 

All 3D renders, lifestyle imagery, and CGIs are artistic impressions only. Actual finishes, landscaping, and amenity appearances may differ. 

Possession Dates 

Timelines are indicative. Legally binding possession dates are those registered in the RERA portal and stated in the Agreement for Sale. 

Amenities 

The list of amenities is indicative. Final amenities are as specified in the RERA-registered project documents. 

  

 For all binding commitments, please refer to the registered RERA documents available at rera.karnataka.gov.in and the executed Agreement for Sale. 

5. Lead Forms and Sales Communications 

By submitting a Lead Form on this Website whether on a landing page, project microsite, Google Lead Form Extension, or Meta Lead Ad you explicitly consent to the following: 

  • Myhna Properties Pvt Ltd and/or its authorised sales team may contact you via phone call, SMS, WhatsApp, and email for the purpose of responding to your enquiry. 
  • Your contact information may be shared with the channel partner attributed to your lead, if applicable, solely for the purpose of scheduling a site visit or follow-up. 
  • You may receive project updates, offers, and construction progress communications until you opt out. 
  • You understand that submission of a Lead Form does not constitute a booking, reservation, or allotment of any unit. 
  • Myhna Properties reserves the right to decline enquiries or discontinue communications at its discretion. 

To opt out of marketing communications, reply STOP to any SMS, click Unsubscribe in any email, or contact myhnaoffice@myhnaproperties.com with the subject “Opt-Out Request”. 

6. Intellectual Property Rights 

All Content on this Website — including but not limited to the Myhna Properties name and logo, “Myhna Vistara”, “Unbounded Living” tagline, project renders, floor plan designs, brochures, videos, photography, blog articles, marketing copy, and the overall Website design is the exclusive intellectual property of Myhna Properties Pvt Ltd or its licensed partners. 

6.1 What You May Do 

  • Download or print Content solely for your personal, non-commercial reference as a prospective buyer. 
  • Share links to specific Website pages on social media for non-commercial, personal use. 
  • Embed publicly available YouTube videos from @myhnapropertiesofficial via the standard YouTube embed feature. 

6.2 What You May NOT Do 

  • Use the Myhna Properties name, logo, or project names in any paid advertisement, keyword bid, domain name, or social media handle without express written permission. 
  • Reproduce floor plans, renders, pricing tables, or brochures in competitor marketing materials, aggregator listings, or third-party websites without written consent. 
  • Create derivative works based on our Content or use our branding to imply endorsement or affiliation. 
  • Republish our blog articles or YouTube video transcripts in full on any other platform. 

Violations of these intellectual property restrictions may result in legal action under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable provisions of the IT Act, 2000.

Myhna Properties does not control the content, privacy practices, or availability of third-party platforms. We are not liable for any loss, damage, or inconvenience arising from your use of linked third-party websites. Links do not constitute our endorsement of those platforms. 

The YouTube channel @myhnapropertiesofficial is operated by Myhna Properties but is hosted on Google’s platform. Comments, community posts, and user-generated interactions on our YouTube, Instagram, and Facebook pages are subject to the respective platform’s Community Guidelines. 

9. Disclaimer of Warranties 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE INDIAN LAW, THIS WEBSITE AND ALL CONTENT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. 

Myhna Properties does not warrant that: 

  • The Website will be available at all times, uninterrupted, or error-free. 
  • The Content is free from inaccuracies, omissions, or typographical errors. 
  • The Website is free from viruses, malware, or other harmful components — although we implement reasonable security measures. 
  • Any specific unit, price, or configuration shown will be available at the time of your enquiry or booking. 

Use of this Website is at your own risk. We strongly recommend that all purchasing decisions be made only after reviewing RERA-registered documents, visiting the project site, and taking independent legal and financial advice. 

10. Limitation of Liability 

To the maximum extent permitted under applicable law, Myhna Properties Pvt Ltd, its directors, employees, marketing partners and channel partners shall not be liable for: 

  • Any direct, indirect, incidental, or consequential loss arising from reliance on Website Content, including pricing, availability, possession timelines, or project specifications. 
  • Loss of profits, business, revenue, or investment value arising from decisions made on the basis of Website information alone. 
  • Any interruption, delay, or failure of the Website, including data loss resulting from technical faults. 
  • Unauthorised access to personal data submitted via the Website, despite our reasonable security measures. 
  • Actions of third parties, including channel partners, property portals, or linked platforms, over which we have no operational control. 

11. User-Generated Content and Reviews 

If you submit a review, testimonial, comment, or any other content on the Website, our Google Business Profile, YouTube channel, Instagram page, or other Myhna Properties-operated platforms, you grant Myhna Properties a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, edit, publish, and distribute that content for marketing, promotional, and editorial purposes. 

By submitting such content, you confirm that: 

  • The content is your own genuine experience and is not fabricated, incentivised without disclosure, or submitted on behalf of a competitor. 
  • The content does not contain defamatory statements, false claims, personal information of third parties, or any material that infringes third-party intellectual property rights. 
  • You have not been coerced or improperly induced to submit a positive review. 

Myhna Properties reserves the right to remove any user-generated content that violates these Terms, applicable law, or the platform’s community guidelines, without prior notice. 

12. Prohibited Activities 

The following activities are strictly prohibited and may result in immediate termination of your access to the Website, legal action, or both:

Submitting bulk or automated lead form entries to probe our CRM or pricing systems.

Publishing misleading or false content claiming to be the official Myhna Properties website or social presence.

Using Myhna Properties’ RERA registration number in any third-party advertisement without authorisation. 

6 

Disseminating our floor plans, pricing documents, or brochures to competitors or for use in competitive intelligence without consent. 

7 

Conducting denial-of-service (DoS) attacks or any attempt to disrupt the Website’s availability. 

8 

Using the Website to distribute malware, spyware, phishing content, or harmful code. 

 

13. Indemnification 

You agree to indemnify, defend, and hold harmless Myhna Properties Pvt Ltd, its directors, officers, employees, agents, and marketing partners from and against any claims, liabilities, damages, penalties, fines, costs, and expenses (including reasonable legal fees) arising from: 

  • Your violation of these Terms of Use. 
  • Your misuse of the Website or any Content therein. 
  • Your violation of any applicable law, including RERA, the IT Act, or consumer protection regulations. 
  • Any third-party claims arising from content you submit, publish, or distribute in connection with this Website. 

14. Modifications to the Website and These Terms 

Myhna Properties reserves the right to: 

  • Update, modify, suspend, or discontinue any part of the Website at any time without prior notice, including pricing information, project pages, and lead capture forms. 
  • Revise these Terms of Use at any time. The updated version will be posted on this page with a revised “Last Updated” date. Where changes are material, we may provide a notice on the Website homepage. 
  • Modify project details, pricing, configuration availability, and amenity lists in line with RERA updates, regulatory approvals, or design changes. 

Your continued use of the Website following any change to these Terms constitutes your acceptance of the revised Terms. We recommend bookmarking and reviewing this page periodically. 

15. Termination of Access 

Myhna Properties reserves the right to suspend or permanently block access to the Website, without notice, for any user who: 

  • Violates any provision of these Terms. 
  • Engages in prohibited activities listed in Section 12. 
  • Submits fraudulent or misleading information in any lead form. 
  • Attempts to compromise the security, integrity, or availability of the Website. 

Termination of access does not affect Myhna Properties’ right to pursue legal remedies for violations already committed. 

16. Governing Law and Dispute Resolution 

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. 

16.1 Jurisdiction 

Any dispute, claim, or controversy arising out of or in connection with these Terms, the Website, or any transaction with Myhna Properties shall be subject to the exclusive jurisdiction of the competent courts at Bengaluru, Karnataka, India. 

16.2 Consumer Disputes 

Consumers (as defined under the Consumer Protection Act, 2019) retain the right to approach the applicable Consumer Disputes Redressal Commission, irrespective of these Terms. RERA-related disputes shall be governed exclusively by the Karnataka Real Estate Regulatory Authority and the Real Estate Appellate Tribunal. 

16.3 Informal Resolution 

Before initiating formal proceedings, we encourage you to contact us at myhnaoffice@myhnaproperties.com to resolve any dispute informally. We will make reasonable efforts to address legitimate concerns within 15 working days.
